Privacy Statement CU Foods- Introduction

CU Foods BV, established and with registered office in Utrecht (hereinafter referred to as “CU Foods”) attaches great importance to the responsible handling of personal data of users of its website www.cufoods.org (hereinafter referred to as “Users”).

CU Foods processes personal data of Users carefully and in compliance with the provisions of the Personal Data Protection Act or, once it has come into effect, the General Data Protection Regulation (GDPR).

In this Privacy Statement, CU Foods informs Users about the way in which CU Foods processes their personal data and how they can change or object to this. This Privacy Statement only applies to the services offered by CU Foods on www.cufoods.org.

Article 1: Explanation of personal data and purposes for processing them

Personal data

CU Foods distinguishes between different types of Personal Data:

Account details: User-supplied account details (name, email address, password). This allows for the provision of services such as contract templates or newsletters. This data is also forwarded to specialist partners for services such as accounting or the customisation or checking of a contract if necessary.

Contract Data provided by the user that is required for the performance of a sales or buying contract, including data that is required under the WWFT and data for identification. Full names, date of birth, place of birth, address details and passport details and data about the company are required for the drawing up of sales contracts and a telephone number is necessary for the performance and coordination of the contract.
This data is processed is also for the purpose of providing a sale contract, as this data must be included in the sales contract. In addition, data that the user provides for due diligence is in the context of the duty of care is also processed. CU Foods analyses this data in order to improve its services in general and more specifically the process with regard to the duty of care.

Communication data: Data regarding email contact and other correspondence between CU Foods and user. This data is necessary to inform users about services or to provide these services. For more information about this, see article 1.9.

Other data: Data that is not provided by the user. See article 5 of this statement.

All Personal Data of a User is stored in the account that User creates on the website www.cufoods.org and the CRM system of cufoods.

CU Foods is at all times responsible for the management of the Personal Data provided by the User and will make every effort to protect that Personal Data. In the event of a data breach, CU Foodswill immediately inform the User of that event via the e-mail address known to it and will make every effort to prevent further dissemination of that Personal Data.

User has the right at all times to have the Personal Data provided by him/her to CU Foods presented to him/her in a clear manner by CU Foods(“right of access”). At the first request of a User, CU Foods will forward his/her Personal Data to a third party to be designated by that User (“right to data portability”) or delete it completely from its system (“right to deletion”).

Any questions a user may have regarding their Personal Data can be addressed to support@cufoods.org.  These questions will be answered within 2 business days at the latest.

Because a User requests a service and provides personal data in categories A, B and C for this purpose, CU FOODS is authorized to use and process this personal data for the performance of the service in connection with which the personal data was provided as referred to in Article 6.1 (b) of the GDPR.

The personal data under categories B, C and D will also be used to improve FIRM24's services and to prevent abuse, qualifying as a legitimate interest as referred to in Article 6.1 (f) of the GDPR.

The personal data will not be used for any other purpose than the purpose stated in this statement, unless the User has given explicit permission for another use of this Personal Data.

Users can call, chat & email with  CU Foods' customer service. In order to quickly help users with questions, we use your data as stated under 1.1 and CU Foods makes notes where necessary. CU Foods may use a CRM system to register data about the telephone conversation and chats in order to analyze these in order to improve our services.

When writing a customer review, users can choose whether personal data is visible to other visitors and whether CU Foods can contact them about the customer review.

Based on previous visits to www.cufoods.org, CU Foods tracks the shopping behavior and personal preferences of users and can adjust its offering accordingly. CU Foods uses cookies for this (if permission has been given), an IP address and information about previous purchases.

If necessary, CU Foods will use user data to investigate or prevent fraud. Upon request, CU Foods will hand over Personal Data as stated under 1.1 to the police, justice and other investigative services or involved third parties, if it is obliged to do so by law, a court order, or if this is necessary to prevent criminal acts or unlawful conduct.

In some places on www.cufoods.org, users can log in with a social media account. The shopping behavior can then be visible on the social media account of the user. CU Foods does not get access to the social media account of the user.

Article 2: Transfer to third parties

CU Foods does not provide personal data to third parties, unless:

The transfer will take place to a third party engaged by CU Foods for the purposes listed in this Privacy Statement, with which third party CU Foods has concluded an agreement that stipulates how this Collaboration Partner will handle your personal data in a responsible manner;

CU Foods is required by law to pass on personal data to competent authorities.

Article 3: Data security

CU Foods uses – to the extent that this may be required of it – appropriate technical and organizational security procedures, including to ensure that unauthorized persons do not have access to data and to prevent the loss, unlawful use or modification of the information that CU Foods receives.

Article 4: Availability and modification of data

Users can request access to their personal data that CU Foodsprocesses at any time. Users can also request to have data changed or deleted. For this, users can send an email support@cufoods.org or use the de-authorization option in your account. If users choose to delete certain personal data, they may no longer be able to use the website because the processing of this personal data is essential for the use of the website.

Article 5: Cookies

CU Foods uses data to offer users the most personalized shopping experience possible. CU Foodsadapts what users see on www.cufood.org to their interests. For example, CU Foods uses data from previous orders, IP addresses and cookies. You can read more about cookies here.

Article 6: Liability of CU Foods

CU Foods has no control over the possible use of your personal data by third parties. This Privacy Statement only applies to the personal data that CU Foodsprocesses for the benefit of www.firm24.com. CU Foods accepts no responsibility or liability for (the operation and/or content of) websites or services of third parties.

Article 7: Retention period

CU Foods stores copies of passports for a period of 30 days from the date of application, unless CU Foods is required by law to store personal data for a longer period

Articles of incorporation and shareholder registers will not be deleted unless a user requests this.

Article 8: Amendment of Privacy Statement

CU Foods reserves the right to amend this Privacy Statement. Any amendment will be announced via www.firm24.com. By using www.cufods.org after amendments, you agree to any amended Privacy Statement. Keep an eye on this page and www.cufoods.org regularly for any amendments.
